Thank you for visiting our website www.careloop.com.au (the Site). This Site is owned and operated by Care Loop Australia Pty Ltd (“CareLoop”) ABN 35 684 267 338. By accessing and/or using this Site and related services, you agree to these Terms of Use, which include our Privacy Policy (available at careloop.com.au/privacy-policy) (Terms). You should review our Privacy Policy and these Terms carefully and immediately cease using our Site and services if you do not agree to these Terms.

In these Terms of Use, ‘us’, ‘we’ and ‘our’ means Care Loop Australia Pty Ltd and our related bodies corporate.

1. Services and Agreement Acceptance

You may use CareLoop to access information and expert consultants for end-of-life planning, including funeral, memorial, cremation, and estate administration services ("Services"). By using the App, you accept these terms by: (a) creating an account and using the App; (b) submitting service requests or information through the App; or (c) making any payments through the App, if applicable.

Any modifications to these terms must be agreed upon in writing between you and us.

2. Authorisation and Responsibilities

By using CareLoop, you confirm that you are authorised to seek information and advice regarding end-of-life planning and that there are no known conflicts with family members or other relevant parties. You agree to provide accurate and complete information required for planning purposes.

3. Third-Party Service Providers

CareLoop may facilitate connections with third-party providers, including funeral homes, crematoriums, cemeteries, florists, caterers, legal professionals, and other service providers ("Service Partners"). While we strive to partner with reliable providers, we do not guarantee their performance and are not responsible for their services.

4. Engagement with Bare Funeral Group

If you choose to go on to engage Bare Funeral Group for any of the following services: Cremations, Funerals, Memorials, Burials, or Estate Administration, you will be governed by the Terms & Conditions for each product as set out on bare.com.au. These Terms & Conditions will apply separately from your use of CareLoop.

5. Payment Terms

If CareLoop facilitates payments for Services, you agree to pay the applicable fees as outlined in the payment section. Payment options may include direct transactions or third-party payment plans. Failure to make timely payments may result in service cancellations or additional fees.

If you opt for a payment plan, you acknowledge that: (a) The plan is provided by a third party, not by us; (b) The third party may conduct a credit check and charge additional fees; (c) We are not liable for any issues related to payment plan approvals or disputes.

6. Privacy and Data Use

We will handle any personal information you provide in accordance with our Privacy Policy. Your data may be shared with Service Partners or relevant authorities as necessary to fulfill the Services you request.

7. Consumer Rights

Your rights under applicable consumer protection laws remain unaffected. Nothing in these terms limits your legal protections regarding the Services provided through CareLoop.

8. Limitation of Liability

To the fullest extent permitted by law, we will not be liable for indirect or consequential loss. Our total liability will be limited to the amount you paid for the Services facilitated through CareLoop.

9. Force Majeure

If circumstances beyond our control prevent the delivery of Services (such as natural disasters or regulatory restrictions), we may cancel or delay the affected portion of the Services without liability.

10. Termination and Survival

Certain clauses, including those related to payment obligations, privacy, and liability, will survive termination of your use of CareLoop.

11. Definitions

  • "Services" refer to the expert consultations, informational resources, and service facilitation available through CareLoop.
  • "Service Partners" include third-party providers engaged in fulfilling requested services.
